If you are a holder of DIN (Director’s Identification Number) whose DIN (Director’s Identification Number) is marked as “Deactivated due to non-filing of DIR-3 KYC”, or a company whose compliance status has been marked as “ACTIVE non-compliant” because of ……, there is some good news! The Ministry of Corporate Affairs (MCA) has taken steps to waive off the filing fees of INR 5000/- for deactivated DIN, and INR 10,000/- for non-compliant companies, for a period of 6 months, starting from April 01, 2020, to September 30, 2020.
Why or When are DINs (Director’s Identification Number) deactivated?
Under the Companies Act, 2013 all the individuals holding "Approved DIN" on or before March 31, 2018, were required to file an eform DIR 3 KYC with the Ministry of Corporate Affairs (MCA) to keep their DIN (Director’s Identification Number) active. No fees are applicable on such filing.
If the filing of eform DIR 3 KYC complied within the previous financial year then such directors were required to confirm their KYC details annually by filing a web form DIR 3 KYC-WEB unless there were any change in the personal details of the director as provided earlier in which case eform DIR 3 KYC was required to be filed with the updated details.
Failure to file the eform DIR 3 KYC/web form DIR 3-KYC-WEB by the DIN (Director’s Identification Number) holder leads to the DIN (Director’s Identification Number) being marked as "Deactivated due to non-filing of DIR-3 KYC" by the Ministry of Corporate Affairs (MCA).
The DIN (Director’s Identification Number) can be activated by filing Form DIR 3 KYC along with a fee of INR 5,000/-. This fee has now been suspended till September 30, 2020. So what are you waiting for? Go ahead and get your DIN activated. Let LexStart help you.
