Has your LLP defaulted in statutory filing? The MCA has some relief for you!

In wake of COVID-19, the Ministry of Corporate Affairs (MCA) has provided an opportunity for Limited Liability Partnerships (LLPs) to rectify any defaults related to statutory filings by Limited Liability Partnerships (LLPs), irrespective of the duration of default.

Any Limited Liability Partnerships (LLPs) which have defaulted in the filing of forms with the statutorily prescribed timelines are typically allowed to file the form with additional fees or apply for compounding of offenses. 

However, in a bid to make it easy for Limited Liability Partnerships (LLPs) to rectify their non-compliance, the Ministry of Corporate Affairs (MCA) has permitted the delayed filings of such forms by the Limited Liability Partnerships (LLPs), without any additional fees. This relief is available to Limited Liability Partnerships (LLPs) only till September 30, 2020.

To summarize:

1. The Limited Liability Partnerships (LLPs) can file all its delayed forms without having to pay any additional fees.

2. The Limited Liability Partnerships (LLPs) shall not be subject to any prosecution by the Ministry of Corporate Affairs (MCA) for any defaults, upon completion of all such filings. 

However, the above shall not apply to those Limited Liability Partnerships (LLPs) which have already made an application to MCA for striking off its name from the register of Limited Liability Partnerships (LLPs) maintained by the Ministry of Corporate Affairs (MCA).
